Comprehensive Guide for Filing a DMCA Notice
If you are a rights owner, or an authorized legal representative, and you believe in good faith that protected work has been copied or displayed in a way that constitutes infringement, a formal claim should be submitted directly to our designated copyright agent. To be processed under the established federal legal framework, a proper DMCA notification must include all of the following specific information:
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly violated in the report.
- Detailed identification of the protected work claimed to have been infringed, or a comprehensive representative list if multiple works are involved in a single claim.
- Precise identification of the material that is claimed to be infringing and that is to be removed, along with direct URLs reasonably sufficient to permit our technical team to locate and identify the file.
- Complete contact information for the complaining party, including a physical mailing address, primary telephone number, and an active electronic mail address for follow-up communication.
- A clear statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the original rights owner, its legal agent, or the law.
- An absolute statement that the information contained in the notification is accurate, and under penalty of perjury, that the complaining party is fully authorized to act on behalf of the owner of an exclusive right that is allegedly violated.
Once a valid and complete notice is received by our legal department, the platform will act quickly to disable access to the potentially infringing material. We strive for a balance of rights; thus, we may also notify the user who originally uploaded the material, providing them with a transparent opportunity to file a formal counter-notification if they believe the removal was a result of an error, a misidentification, or falls under fair use permissions.
Zero-Tolerance Repeat Infringer Policy
In strict accordance with international copyright laws, our platform maintains a firm policy regarding the termination of accounts belonging to users who are identified as repeat infringers. The service reserves the absolute right to disable access and delete profiles for any individual or entity that repeatedly violates the intellectual property rights of creators. This determination is made based on a thorough review of the number of valid claims received, the nature of the violations, and the user's history of compliance with our community standards.
Counter-Notification Procedures
If a user believes that their content was removed by mistake or misidentification, they may file a counter-notification with our designated agent. This document must include the user's physical or electronic signature, identification of the material that has been removed, and a statement under penalty of perjury that the user has a good faith belief that the material was removed as a result of mistake or misidentification. Upon receipt of a valid counter-notice, the platform may restore the content unless the original complaining party files a court action.
